The City of Totana received yesterday, May 10, the resolution of the General Secretariat of Infrastructure of the Ministry of Development of the file of forced expropriation motivated by the works of the Adif-Alta Velocidad project, in reference to the basic project of the line aerial connection to 400 Kv double circuit from the Totana substation of REE to the traction of Adif.
In addition, the schedule of expropriations of the aforementioned project has been received, relating to the affected farms in this municipality, which has an exposure period of fifteen days.
The BORM published on April 30 the resolution of the General Secretariat of Infrastructures dated April 12, 2018 which opens public information corresponding to the file of forced expropriation 020ADIF1815, motivated by the works of Adif-High Speed, "Project basic of the connection line to 400 kv double circuit from the substation of Totana REE to the Totana de Adif traction substation ", in the municipality of Totana (Murcia).
ADIF-Alta Velocidad, on March 14, 2018, urges the initiation of the compulsory expropriation file to dispose of the land necessary for the execution of the project works, which has been duly approved with date, September 19, 2017.
Said works are included in the regulations of Law 38/2015 of September 29 of the Railway Sector, Chapter II on Planning, Project and Construction of Infrastructure integrating the railway network of general interest, which implies, in accordance with its Article 6.2, that the approval of the project referenced in the heading of this document entails the declaration of public utility and the urgency of the occupation for the purpose of forced expropriation and the application of the precepts contained in article 52 of the Law of Forced Expropriation of 16 December 1954 and concordant of its Regulation of April 26, 1957.
In virtue thereof, and for the purposes indicated in Title II, Chapter II, of the current law of Forced Expropriation and in the concordant of the Regulations for its application, this General Secretariat of Infrastructures has resolved to open public information for a period of 15 (fifteen ) business days, counted in the manner provided in article 17 of the Regulations of April 26, 1957, so that the owners of the assets and rights affected by the execution of the works and all other interested persons or entities, can formulate written before this Department, the allegations that they deem appropriate, in accordance with the provisions of Articles 18 and 19 of the Law of Forced Expropriation and Article 56 of the Regulations for its application.
The Expropriation Schedule may be consulted both in the premises of the Ministry of Development, General Secretariat of Infrastructures, Railway Expropriations Division, Paseo de la Castellana, 67;
in ADIF-Alta Velocidad, Avenida Pío XII, 110 (Caracola No. 18);
in the respective affected Town Halls, as well as in the Sub-delegations of Government or Government Delegations, as the case may be.
In the same way it is resolved to summon the owners of the affected goods and rights, to the lifting of the minutes prior to the occupation in the place, days and hours that are indicated below.
This publication will serve as a notification for the unknown or ignored domicile for the purposes provided for in Law 39/2015, of October 1, on the common administrative procedure of the public administrations.
However, interested parties will be summoned to the act of lifting the previous records, by individual citation.
