The Court of Contentious Administrative Number 2 of Murcia has partially upheld the appeal filed by SOCAMEX, SA and Urbaser, SA, against the alleged dismissal for administrative silence of the application for liquidation of the concession contract for the public service of drinking water supply to address and sewer system that occurred in July 2012.
The mayor, Andrés García, and the councilor of the Treasury, Ana María Cánovas, have given an account of the ruling known today, which can be appealed, and which would oblige the Totanero Consistory to pay the former concessionaire more than 5.9 million euros. euros, procedural costs incurred in the separate procedure.
The mayor has announced that the legal services of the city are studying it "carefully" but has advanced that "although the sentence is not firm, it may not recur";
because the initial demand of the company Urbaser, SA claimed about 10 million euros for the damage caused after unilaterally breaking the exploitation contract in the previous term.
Precisely, this concessionaire had made an advance payment of the canon of extension of the contract and the fee for reviewing tariffs amounting to 6.2 million euros, which did not invest in the improvement of the drinking water supply network, as explained the ruler of Totana.
Municipal officials have recalled that it was terminated before expiration alleging problems of technical performance of the network and have lamented that this "is not good news" because it recognizes an added debt to be paid by all residents of Totana, that "is inheritance from other legislatures".
In addition, to this situation are added the limitations and measures imposed by the Ministry of Finance to the City Council with the Adjustment Plan to deal with the day to day in the municipal activity.
The mayor stressed that at the beginning of the legislature this municipal government found a debt of more than 8 million euros with the Mancomunidad de Canales del Taibilla, which is being solved;
and that adds to the six million euros of this ruling.
At present, the debt of the Totanero Consistory exceeds 121 million euros (180 if contingencies are included, as can be seen from the economic-financial study prepared at the beginning of this term);
so to pay the sentence to Urbaser the council should benefit from state aid funds to local entities next year, because for the current and is out of time, as they said.
