The Mayor's Office issued a side in which the owners of lots of the urban area, El Paretón and the urbanization “La Charca” are informed so that, as of the date of said communication, they proceed to clean and maintain them in the due conditions of safety, health and public decoration.
This side indicates that, if the cleaning is not carried out by the obligated owners, the execution order will be issued, in accordance with the provisions of article 270 of Law 13/15, on Territorial and Urban Planning of the Region of Murcia , being the cleaning works, in case of non-compliance, executed by the City Council at the expense of the owner, without prejudice to the initiation of the corresponding disciplinary proceedings.
This communication has been promoted, having knowledge on the part of the competent Municipal Services, of the state in which there are numerous plots of the urban area of ​​the population, which sometimes present an abundance of herbs and deposits of waste and garbage, with the consequent risk of fire, as well as the negative consequences that they entail for health, the environment and public decoration for neighbors and visitors.
It is the responsibility of the municipality, attributed by the Law Regulating the Bases of Local Regime, civil protection and fire prevention and protection of the environment and public health.
The legal urban content of the land ownership right is formed, among others, by the duty of the owners to maintain it in the conditions of safety, health, universal accessibility and public decoration, as expressed by the Law of Territorial and Urban Planning of the Region of Murcia in its article 110.
The Municipal Ordinance of Urban Hygiene of the City Council of Totana obliges the owners of the land, constructions and buildings to carry out the works and works necessary to keep them in conditions of safety, health and public decoration.
